Privacy Policy of HarmonyTech Limited

Preamble

HarmonyTech Limited ("we", "us", "HarmonyTech") is committed to robust, secure, and transparent privacy practices. We strive to protect your privacy and prevent misuse or abuse of your personal data. Because we value your privacy and aim to make our services safe and enjoyable for everyone:

  • We never sell personal data to anyone.
  • We strictly adhere to Hong Kong’s privacy laws for all processing activities.
  • You always have control over your personal information.

Our Privacy Policy explains what information we collect and why, how we use, share, and protect this information. It applies to:

  • Our clients (including their internal users, “Client Users”)
  • The end-users (“End Users”) who interact with our clients on supported platforms via social profiles.

Please read our clients’ specific privacy policies alongside this one for more detailed information on how they handle your personal data, as well as the privacy policies of supported platforms.

If you have any questions or complaints about our Privacy Policy or practices, please contact us at [email protected].

1. What is HarmonyTech?

HarmonyTech is headquartered in Hong Kong and provides a software application (“Service”) that helps businesses and organizations (individually and collectively, “Clients”) manage their social media profiles. The nature of our service allows Clients to centralize their social media profiles, manage incoming messages, comments on posted content, schedule and publish content, analyze results, and monitor public conversations containing selected keywords on supported platforms. HarmonyTech complies with Hong Kong data privacy laws.

2. What Information Do We Collect and/or Process?

We collect and/or process various types of information, including but not limited to personal data (“Client Data”):

  • Client Personal Data: Collected and processed for our own purposes, such as providing and managing the Service.
  • Client Content: Processed according to instructions provided by Clients through the Service, including information and End User messages collected from supported platforms. Clients control how they collect and use their Client Content.

We do not collect/process sensitive data as it is technically prohibited by using the Service.

2.1 Client Personal Data

Types of Data

When you first register for a HarmonyTech account and use the Service, we collect some of your data, including but not limited to your full name, email address, company name, company address, company phone number, social profile URLs, and content posted on connected social profiles. We may also receive information related to communications you send us, such as inquiries or comments about our Service.

HarmonyTech automatically collects and receives certain data from your computer or mobile device, including your activities on this site, the Service, supported platforms, the type of hardware and software you use (e.g., operating system or browser), and information obtained from cookies (see below “Cookies and Related Technologies”).

For instance, each time you visit this site or otherwise use the Service, we automatically collect your IP address, browser and device type, access times, referring web pages, areas of the website you browse, and web pages you visit (if applicable).

How We Use It

HarmonyTech uses Client Personal Data for general purposes such as:

  • Identifying you when you log into your Service account
  • Operating the Service and providing it to you
  • Verifying transactions and purchase confirmations, billing, security, and authentication (including secure tokens for communication with supported platforms)
  • Analyzing the website or Service and user information to improve content and services
  • Contacting you regarding your account and providing customer support
  • Keeping you informed about potentially useful information or requested updates
  • Selling or marketing services, features, surveys, newsletters, offers, contests, and events
  • Understanding your needs, diagnosing issues, analyzing trends, improving Service functionality and availability, and marketing
  • Ensuring the Service remains secure and reliable
2.2 Client Content

When Clients connect their social profiles to the Service, they can choose to immediately collect, process, share, and access such social profiles (subject to the terms of service and privacy policies of supported platforms).

Through this, Client Users can obtain, use, and analyze data from chosen supported platforms and create, post, transmit, view, display, or share data or information via the Service.

Types of Data

  • Client-generated content (e.g., messages, posts, comments, profile pictures, images, feeds, or communications exchanged on supported platforms)
  • End User messages and/or names
  • URLs of End User social profiles on supported platforms
  • Supported platform user IDs
How We Use It

HarmonyTech uses Client Content for purposes such as:

  • Identifying authors of End User messages
  • Aggregating all End User messages from the same individual and providing a history of past dialogues between End Users and Clients

Third-party Applications and Social Networks

The Service enables an ecosystem where you can choose to connect with supported platforms. If you choose to send your content to supported platforms, HarmonyTech no longer holds responsibility for that content once it leaves the Service. Instead, the content will be governed by the terms and privacy policies of the relevant supported platform. For example, if you post a message on Facebook using the Service, Facebook's privacy policy and terms of service will apply to the message on Facebook servers.

3. Cookies and Related Technologies

Like many websites, we collect certain information through “cookies,” small text files saved by your browser when you visit our website. We may use both session cookies and persistent cookies to identify you as logged into the website and understand how and when you interact with our website.

We may also use cookies to monitor overall usage and traffic routing on our website and customize and improve our Service.

By accessing the website or using the Service, you agree to the use of cookies and HTML-based emails in your browser.

Most browsers allow you to choose whether to accept cookies. If you do not wish to place cookies on your computer, set your browser preferences to reject all cookies before visiting this site. Note that doing so may render certain functions of the website and Service unavailable.

HarmonyTech may also use related technologies, including web beacons, pixels, and software tokens, to facilitate your use of the Service. Notably, the Service uses software tokens (securely stored on HarmonyTech-controlled servers) to facilitate login and operation across two supported platforms.

4. How Is Your Information Protected?

Your personal information security is important to us. HarmonyTech has taken various measures to ensure information is adequately protected against unauthorized access, use, disclosure, and destruction. While risks cannot be eliminated, they can be significantly mitigated and reduced. Remember, submitting information via the Internet is never entirely secure.

All measures taken by HarmonyTech significantly reduce the risk. HarmonyTech is not liable for unauthorized access, use, and/or disclosure of information by any third party, including you, unless such actions result from HarmonyTech's gross negligence, intentional misconduct, fraud, or malice.

Security measures taken by HarmonyTech include:

  • Access to information stored on HarmonyTech servers is limited to a select few HarmonyTech employees;
  • Industry best practices are used to secure any information collected and/or transmitted to supported platforms. Both the website and Service are protected by SSL protocol, which encrypts all transmitted data;
  • HarmonyTech servers are protected by firewalls, creating a barrier between our trusted, secure internal network and the Internet, and IP restrictions limit access to whitelisted IPs;
  • Each client can only access information related to the social profiles they track and specific End Users interacting with those profiles. For Twitter and Instagram, clients can also access publicly available content posted by End Users containing specific keywords;
  • When processing payments via credit card, HarmonyTech uses PCI_DSS-compliant third-party suppliers;
  • HarmonyTech regularly reviews its information collection and processing practices and will review and modify this Privacy Policy accordingly.
  • Third-party suppliers are used to prevent attacks on the website or Service and the destruction or theft of data. These suppliers also monitor potential attacks to notify HarmonyTech clients if their Client Content and/or HarmonyTech data are compromised;
  • HarmonyTech takes reasonable security measures to protect your personal information against loss, misuse, unauthorized access, disclosure, alteration, and destruction. However, please note that despite our efforts, no security measures are 100% foolproof.

5. Children

Given the nature of our Service, it is not attractive to children under 13 years old. Therefore, HarmonyTech does not intentionally collect or receive PII from children under 13. If we later learn that any user of our Service is under 13 years old, we will take appropriate steps to delete that user's information from our account database and restrict future access to the Service.

6. Your Rights: Access, Modification, Deletion, Disclosure

You have the right to object to the processing and collection of your personal data and can withdraw consent at any time, subject to applicable law.

Withdrawal of consent means immediate termination of your use of the Service. You can request modification or deletion of your information at any time by emailing [email protected], including your full name and the URLs of all social profiles connected to the Service. Such requests must come from the email address used to create the Service account.

Note that HarmonyTech may need to retain certain personal information after canceling your account for a period required by our legitimate business purposes or as required or authorized by applicable law.

Be aware that HarmonyTech acts as a bridge between our Clients and various supported platforms. In some cases, content published via HarmonyTech is not under HarmonyTech's custody or control, and any content you share via any supported platform through the Service may continue to be available to third parties and the general public, now controlled by the operators of the supported platform.

HarmonyTech does not rent or sell your Client Personal Data or Client Content but may disclose such data to a limited group of trusted third parties under the circumstances described herein, to which you explicitly agree by using our Service. We will disclose your personal information in accordance with the law, court order, and to meet any legal or regulatory requirements or obligations. We will make every reasonable effort to ensure these requirements or obligations comply with applicable law.

We reserve the right to disclose your information to any third party if we reasonably believe it is necessary to investigate and/or enforce any breach of the Service Terms (if applicable), detect, prevent, or otherwise address fraud, security, technical issues, or other violations, and protect HarmonyTech's rights and property.

We reserve the right to disclose your information to parent companies, subsidiaries, joint ventures, or other entities under common control with HarmonyTech.

In the event of acquisition or merger by another entity, we reserve the right to disclose your information (in which case we will require the entity to assume our obligations under this Privacy Policy or notify you that you are protected by a new privacy policy).

7. Notice and Amendments to the Privacy Policy

If you have any concerns about your privacy, please send an email to HarmonyTech at [email protected] with a detailed description of your concern. HarmonyTech will make every effort to resolve such issues within a reasonable time.

We may revise this Privacy Policy from time to time.

7.1 Consent

By using the Service, submitting personal information to the Service, or collecting personal information from supported platforms via the Service, you agree to the collection, transmission, storage, disclosure, and use of your personal information as specified in this Privacy Policy. If you do not agree to these uses of your personal information, you should avoid using the Service.

7.2 Governing Law and Dispute Resolution

These Service Terms shall be governed by and construed in accordance with the laws of Hong Kong without regard to its conflict of law principles.
